Apple and medical technology company Masimo have a long history, with the latter recently suing in 2020 seeking damages for patent infringement. Today, a court found her Apple guilty, and the U.S. International Trade Commission is set to consider banning imports of the Apple Watch Series 6 and newer.

Just before the first Apple Watch was released, the Cupertino-based company was looking to collaborate with Masimo. However, his CEO of Masimo said the purpose of the meeting was to poach certain employees for information and expertise on specific Masimo products. More precisely, the latest blood oxygen sensor technology used in hospitals.
That said, Apple actually signed Masimo’s chief medical officer shortly after the meeting.
As a result, Masimo sued Apple in 2020 for infringing 10 different Masimo patents, seeking a ban on Apple Watch sales in the United States.
The USITC’s final decision is still pending and will be difficult to unravel. The committee should scrutinize Apple’s pulse oximeters and their implementations to determine whether Apple used his Masimo trade secrets in developing mobile technology. The USITC operates independently of the courts and may reach different decisions.
